6. AI Features and Machine Learning

• Subject to errors and inaccuracies

7. Fees and Payment

• Grandfather existing users with special pricing where applicable

9. Limitation of Liability

AUREUM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUREUM SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Financial losses resulting from decisions made using our platform
• Service interruptions, data loss, or system failures
• Unauthorized access to or use of your data
• Errors or inaccuracies in AI-generated content

9.3 Maximum Liability Cap

Our total liability to you for any claims arising from your use of Aureum shall not exceed R1,000 (One Thousand South African Rand) or the amount you paid us in the past 12 months, whichever is greater.

9.4 Exceptions

Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Aureum, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your violation of these Terms
• Your use or misuse of the service
• Your violation of any rights of a third party
• Your violation of any applicable laws or regulations
• Any financial decisions you make based on Aureum data

11. Service Availability and Modifications

11.1 Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to Aureum. The service may be temporarily unavailable due to:

• Scheduled maintenance (with advance notice)
• Emergency repairs or updates
• Server failures or technical issues
• Force majeure events beyond our control
• Third-party service disruptions

11.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of Aureum at any time, with or without notice. We may add or remove features, change functionality, or alter the user interface as we see fit to improve the service.

11.3 Beta Features

We may offer beta or experimental features that are clearly marked as such. These features are provided "as is" and may be unstable, incomplete, or subject to change without notice.

12. Third-Party Services and Links

13. Dispute Resolution

13.1 Informal Resolution

If you have any dispute with Aureum, you agree to first contact us at legal@aureumai.tech to attempt to resolve the matter informally. We commit to responding within 7 business days.

13.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

13.3 Arbitration

Any disputes not resolved informally shall be settled by binding arbitration in accordance with the Arbitration Act of South Africa. The arbitration shall take place in Johannesburg, South Africa, and shall be conducted in English.

13.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Termination

14.1 Your Right to Terminate

You may terminate your account at any time by:

• Using the account deletion feature in your profile settings
• Contacting our support team at support@aureumai.tech
• Exporting your data before deletion (recommended)

14.2 Our Right to Terminate

We may suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse our platform or other users
• Remain inactive for more than 2 years
• Fail to pay fees (if applicable in the future)

14.3 Effect of Termination

Upon termination:

• Your access to Aureum will cease immediately
• Your data will be deleted within 30 days
• Sections of these Terms that by nature should survive will continue to apply
• You remain liable for any actions taken before termination

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aureum regarding use of the service.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure to perform our obligations due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15.6 Notices

All notices to you will be sent to the email address associated with your account. You agree that email is an acceptable form of notice. Notices to us should be sent to legal@aureumai.tech.
